Hearing on Omar Abdullah's divorce case with Payal on Nov 4
New Delhi:The Supreme Court has postponed the hearing of the divorce case of former Jammu and Kashmir Chief Minister Omar Abdullah with his wife Payal Abdullah. A bench headed by Justice Sudhanshu Dhulia ordered the next hearing of the case on November 4.
During the hearing on Monday, senior advocate Shyam Divan, appearing for Payal Abdullah, said that the first round of mediation has been done. After that the court ordered to postpone the hearing. It is worth mentioning that on August 30, the court had ordered to send this case to the mediation center. The court had said that although many times there is no scope for improving the relationship in marriages, still an attempt can be made once. Both of you should try to resolve the matter through mediation.
The court, while hearing Omar Abdullah's petition, had issued a notice to Payal Abdullah on July15.During the hearing, Kapil Sibal, the lawyer appearing for Omar Abdullah, had said that the marriage of both is dead. They have been living separately for the last 15 years.
On 12 December 2023, the Delhi High Court rejected Omar Abdullah's divorce petition. Omar has approached the Supreme Court against the decision of the High Court. Omar Abdullah had accused Payal Abdullah of harassing him. Earlier, the trial court had also rejected Omar Abdullah's divorce petition on 30 August 2016.
During the hearing in the High Court, Omar Abdullah had said that the alimony demanded by Payal and their two sons is not acceptable. Payal Abdullah's lawyer strongly opposed this argument of Omar and said that Payal has been living alone since 2016 and she is not being given any expenses. She does not even have money to pay the fees of her sons. Umar had said that Payal can manage her expenses as she has her own business and also has a house in Delhi. Her sons have also grown up now and they cannot ask for maintenance allowance.
